ISLAMABAD: Justice Shaukat Aziz of Islamabad High Court observed that the terms of Faizabad agreement are in contradiction with the law of the land.
The single judge bench was hearing the Faizabad dharna case.
On last hearing, Justice Shaukat had lashed out at the government for succumbing to the protesters pressure and questioned army's role in brokering the deal.
Attorney General Ashtar Ausaf informed the court that the Supreme Court has taken suo moto notice of the matter. The AG sough time from the court for submission of a comprehensive report in this regard.
Petitioner pleaded the court that his case is different from what is being heard in the apex court. My client was kidnapped and beaten up by the protesters, while the militants were handed out cash. On this, the IHC judge said that we know more facts than you. Referring to the agreement, Justice Shaukat observed that the state surrendered before the protesters. There's nothing lawful in it, he noted.
The government should take the matter to the parliament and convene a joint session of both the houses to discuss it.
Last Monday, the IHC came hard on the military over the controversial agreement with Khadim Hussain Rizvi-led party.
Under what authority a serving major general had signed the agreement as an arbitrator, he asked. "The army officers eager to participate in politics should first return their guns to the state, take retirement and then join politics."
The judge said: "Besides a number of serious objections to the terms of agreement, the most alarming is that Major General Faiz Hameed put signatures as the one through whom the agreement arrived. It is also very strange that efforts of General Qamar Javed Bajwa, Chief of Army Staff, have been acknowledged. This court has serious reservations about the terms of agreement and mannerism in which it arrived; however, the federal government has to satisfy the court about the constitutional role of the armed forces and an acknowledgment by the federal government/executive of the country regarding the role of armed forces as an arbitrator".
